Terms of Service
Last updated: October 22, 2026
Draft — pending legal review
1. The agreement
These terms are an agreement between WindyHOA ("WindyHOA", "we", "us") and the homeowners or condominium association that uses the service (the "Association" or "you"). The person who creates the Association's account accepts these terms on the Association's behalf and confirms they are authorized to do so, for example as a member of its board. Everyone who signs in to WindyHOA, including people invited by the board, must also follow these terms.
If you do not agree, do not use WindyHOA. Our Privacy Policy explains how we handle personal information and is part of these terms.
2. The service
WindyHOA is web software that helps a self-managed association keep its records in one place: units and owners, dues and payments, income and expenses, budgets, maintenance requests, vendors, building components, documents and photos, meetings and communications. You can optionally connect the Association's bank account so transactions are imported automatically.
WindyHOA is a record-keeping tool. It is not an accounting, legal, tax or financial-advice service, it does not hold or move money, and it does not replace the professional review your governing documents or the law may require (for example, audits or reserve studies).
3. Accounts and access
- Each person signs in with their own account. Keep your password private and tell us if you think your account was misused.
- The Association's board decides who has access. Board members can invite others and choose their role (President, Secretary, Treasurer, Member or Resident). Presidents can change roles and remove people. The Association is responsible for what its users do in WindyHOA.
- You must be at least 18 years old to create an account.
4. Free trial
A new Association gets a 30-day free trial with no credit card required. When the trial ends without a subscription, the Association's data becomes read-only: you can still sign in, view and export everything, and subscribe, but you cannot add or change records until you do.
5. Subscription and billing
- Subscriptions are billed per Association, monthly or yearly, at the prices shown on our website when you subscribe. Payments are processed by Stripe; we never see or store full card numbers.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- Prices do not include taxes unless stated. You are responsible for any applicable taxes.
- We may change prices for future billing periods. We will tell the Association's billing contact at least 30 days before a price increase takes effect.
- If a payment fails, Stripe will retry it for a period. If the subscription is then cancelled or remains unpaid, the Association's data becomes read-only as described in section 4.
6. Cancellation and refunds
A board member can cancel at any time from Settings → Subscription. The subscription stays active until the end of the period already paid for and is not renewed. Fees already paid are not refunded, including for partial periods, unless the law requires otherwise. If you believe you were charged in error, contact us at support@windyhoa.com and we will review it.
7. Your data
- You own your data. Everything the Association and its users put into WindyHOA, including records about owners, residents and vendors ("Customer Data"), belongs to the Association.
- The board controls resident data. For personal information about owners, residents and other people in the Association's records, the Association is the party that decides why and how it is used. WindyHOA processes it only on the Association's behalf, to provide the service. The Association is responsible for having the right to collect that information and share it with us, and for answering requests from those people (we will help).
- What we may do with it. You give us permission to store, copy, process and display Customer Data only as needed to run, secure, support and improve the service. We do not sell Customer Data, use it for advertising, or share it except with the service providers listed in our Privacy Policy or when the law requires it.
- Getting your data out. A President can download all of the Association's records at any time, including while the data is read-only, from Settings → Data.
8. Bank connections
Bank linking is optional and is provided through Stripe Financial Connections, which is subject to Stripe's own terms and privacy policy. WindyHOA receives read-only account details (such as the bank name, account type and last four digits), balances and transactions. We cannot move money. Imported data is only as accurate as what the bank reports; review it before relying on it. A board member can disconnect a bank account at any time.
9. Acceptable use
You agree not to:
- break the law, or upload content you do not have the right to share;
- upload malware, or try to access accounts, Associations or data that are not yours;
- probe, overload or disrupt the service, or get around its security or usage limits;
- use WindyHOA to send spam or harass anyone;
- copy, resell or reverse-engineer the service, except where the law allows it.
We may suspend access that breaks these rules or puts the service or other customers at risk.
10. Availability and changes
We work to keep WindyHOA available and your data safe, but we do not promise uninterrupted or error-free service, and there is no service-level agreement. We may need to take the service down for maintenance. We may add, change or remove features; if we remove a feature you rely on, we will try to give reasonable notice.
11. No warranty
WindyHOA is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. You are responsible for checking the accuracy of your records, keeping any copies your governing documents or the law require, and complying with laws that apply to your Association.
12. Limitation of liability
To the extent the law allows: (a) neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible; and (b) WindyHOA's total liability for all claims relating to the service is limited to the amount the Association paid us in the 12 months before the claim arose, or US$100 if it paid nothing. These limits do not apply where the law does not allow them to.
13. Ending the agreement
- You can stop using WindyHOA and cancel at any time (section 6).
- We may end or suspend the agreement if you seriously or repeatedly break these terms, or if we stop offering the service. Unless the breach is urgent, we will give notice first; if we stop offering the service, we will give at least 30 days' notice so you can export your data.
- Data after the end. After a subscription ends, the Association's data stays available read-only so you can export it. To have it deleted, a President can email support@windyhoa.com from the account's address. We delete it from the live service within 30 days of confirming the request; copies in backups and deleted-file retention expire on their normal schedule (see the Privacy Policy).
- Sections 7, 11, 12, 13 and 14 continue after the agreement ends.
14. Governing law
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute will be heard in the state or federal courts located in Cook County, Illinois, and both parties consent to those courts.
15. Changes to these terms
We may update these terms. If a change is material, we will tell the Association by email or in the app at least 30 days before it takes effect. Continuing to use WindyHOA after that means you accept the updated terms. The date at the top shows when they last changed.
